1. Introduction
Welcome to Cositas de Panamá.
These Terms & Conditions govern all experiences offered under the commercial brand Cositas de Panamá and operated by CDP Tours Travel and Logistics, S.E.P. (hereinafter referred to as "Cositas de Panamá," "Cositas de Panamá Tours," "we," "our," or "us").
By booking, purchasing, or participating in any of our experiences, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
These Terms apply to all experiences offered directly through our website, booking platform, social media channels, travel partners, or any other authorized sales channel.
2. Definitions
For the purposes of these Terms & Conditions, the following definitions apply:
Experience
An Experience refers to any tour, excursion, activity, transportation service, cultural experience, nature experience, or tourism-related service offered by Cositas de Panamá.
Private Experience
A Private Experience is reserved exclusively for the traveler(s) included in the booking. No unrelated participants will join the experience.
Private Experiences may offer limited flexibility regarding timing or itinerary when operationally possible.
Shared Experience
A Shared Experience is conducted with multiple travelers who have booked independently.
Shared Experiences follow fixed schedules, routes, pickup windows, and itineraries that cannot be modified individually.
Guest
A Guest is any person participating in an experience booked through Cositas de Panamá.
Booking
A Booking refers to a confirmed reservation made through our website, booking platform, travel partner, or authorized representative.
Operator
The Operator refers to CDP Tours Travel and Logistics, S.E.P., operating under the commercial brand Cositas de Panamá.
3. Bookings & Reservations
All bookings are subject to availability.
A reservation is considered confirmed only after:
- payment has been successfully processed;
- confirmation has been sent by Cositas de Panamá; and
- operational availability has been verified.
Guests are responsible for ensuring that all booking information is accurate, including:
- participant names;
- contact information;
- pickup location;
- cruise information, if applicable;
- accommodation details;
- special requests;
- dietary restrictions;
- medical conditions that may affect participation.
Failure to provide accurate information may affect the operation of the experience.
4. Experience Types
Cositas de Panamá currently offers two categories of experiences:
Private Experiences
Private Experiences are designed exclusively for the travelers included in the reservation.
Depending on operational availability, these experiences may allow limited flexibility regarding:
- pickup time;
- pace of the experience;
- duration of individual stops;
- optional adjustments approved by the guide.
Operational, safety, weather, and attraction schedules always take precedence.
Shared Experiences
Shared Experiences are designed for multiple travelers participating together.
To provide a smooth experience for everyone, Shared Experiences operate under fixed operational guidelines.
These include:
- fixed departure times;
- predetermined itineraries;
- designated pickup windows;
- established activity order;
- shared transportation.
Individual itinerary modifications are not available for Shared Experiences.
Guests agree to respect the schedule and the comfort of all participants.
5. Experience Modifications
Cositas de Panamá strives to operate every experience exactly as advertised.
However, we reserve the right to make reasonable operational modifications whenever necessary.
Modifications may include, but are not limited to:
- itinerary adjustments;
- route changes;
- change in activity order;
- alternative attractions;
- different pickup sequence;
- schedule adjustments;
- replacement of transportation or equipment.
These modifications may become necessary due to:
- weather conditions;
- road closures;
- Canal operations;
- attraction availability;
- government restrictions;
- safety concerns;
- traffic conditions;
- operational requirements;
- unforeseen circumstances beyond our reasonable control.
Whenever possible, guests will be informed in advance.
Reasonable modifications made to ensure safety or operational continuity shall not constitute grounds for compensation or refund.
6. Guest Responsibilities
Guests are responsible for ensuring that they are physically able to participate in the booked experience.
By participating, each guest agrees to:
- Arrive at the designated pickup location on time.
- Follow all instructions provided by guides, drivers, boat captains, and authorized staff.
- Respect fellow participants, local communities, wildlife, and cultural heritage.
- Behave in a respectful and responsible manner throughout the experience.
- Wear appropriate clothing and footwear for the activities involved.
- Inform Cositas de Panamá before the experience of any medical condition, allergy, dietary restriction, pregnancy, or mobility limitation that may affect participation.
- Supervise any minors traveling under their responsibility at all times.
Guests are responsible for their personal belongings throughout the experience. Cositas de Panamá is not responsible for lost, stolen, or damaged personal items.
Guests whose behavior endangers themselves, other participants, staff members, or the operation of the experience may be removed from the experience without refund.
7. Safety & Participation
The safety of our guests is our highest priority.
While Cositas de Panamá takes reasonable precautions to provide safe and enjoyable experiences, participation in tourism and outdoor activities involves inherent risks that cannot be completely eliminated.
These risks may include, but are not limited to:
- Transportation by road or water.
- Walking on uneven terrain.
- Exposure to wildlife.
- Weather conditions.
- Physical activities.
- Remote locations.
- Delays beyond our control.
By participating, guests voluntarily assume these inherent risks.
Guests agree to comply with all safety instructions issued by guides, drivers, boat captains, local authorities, or attraction personnel.
If a guide determines that a guest's behavior creates a safety risk for themselves or others, Cositas de Panamá reserves the right to refuse or terminate that guest's participation without refund.
8. Weather & Operational Conditions
Most experiences operate as scheduled under normal weather conditions, including light rain.
However, guest safety always takes priority.
Cositas de Panamá reserves the right to modify, postpone, reschedule, or cancel an experience if conditions make its safe operation impossible or inadvisable.
Such conditions may include, but are not limited to:
- Severe weather.
- Electrical storms.
- Flooding.
- High winds.
- Unsafe sea conditions.
- Canal operational restrictions.
- Road closures.
- Government restrictions.
- Public safety concerns.
- Mechanical failures.
- Other operational circumstances beyond our reasonable control.
Whenever possible, reasonable alternatives will be offered.
9. Transportation & Logistics
Transportation is provided according to the specific experience booked.
Pickup times are carefully planned to ensure efficient operations for all guests.
Guests are responsible for being ready at the agreed pickup location during the scheduled pickup window.
For Shared Experiences
- Pickup routes are optimized to accommodate multiple participants.
- Pickup order cannot be modified upon request.
- Delays caused by individual guests may affect the experience of the entire group.
For Private Experiences
Reasonable adjustments to pickup times or logistics may be accommodated when operationally feasible and agreed upon in advance.
Transportation schedules are subject to traffic conditions, weather, road closures, and other operational factors.
Estimated travel times are approximate and may vary.
10. Punctuality
Punctuality is essential for the successful operation of all experiences.
Guests are expected to be ready at the agreed pickup location before the scheduled pickup time.
Shared Experiences
Shared Experiences operate on strict schedules to ensure fairness to all participants.
If a guest is not present within five (5) minutes of the scheduled pickup time, the experience may depart without them.
Failure to arrive on time will be considered a No Show, and no refund will be provided.
Private Experiences
Private Experiences include a courtesy waiting period of up to thirty (30) minutes, unless otherwise specified.
After this period, the experience may be considered a No Show.
11. Third-Party Service Providers
Certain experiences may include services provided by independent third parties, including but not limited to:
- Restaurants.
- Museums.
- Visitor centers.
- Indigenous communities.
- Hotels.
- Transportation companies.
- Boat operators.
- National parks.
- Local attractions.
While Cositas de Panamá carefully selects its partners, we are not responsible for the independent decisions, policies, schedules, or operational changes made by third-party providers.
12. Force Majeure
Cositas de Panamá shall not be liable for cancellations, delays, modifications, interruptions, or failure to perform any obligation resulting from events beyond our reasonable control.
Force majeure events include, but are not limited to:
- Natural disasters.
- Hurricanes.
- Floods.
- Earthquakes.
- Severe weather.
- Public health emergencies.
- Government actions or restrictions.
- Civil disturbances.
- Labor strikes.
- Transportation disruptions.
- Canal operational restrictions.
- Utility failures.
- Any other unforeseen event beyond our reasonable control.
In such situations, Cositas de Panamá will make reasonable efforts to provide alternative arrangements whenever possible.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Cositas de Panamá shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from participation in any experience.
Our liability shall not extend to:
- Personal belongings.
- Travel delays.
- Missed flights or cruise departures.
- Hotel expenses.
- Loss of enjoyment.
- Circumstances caused by third parties.
- Events beyond our reasonable control.
Nothing in these Terms & Conditions limits any rights that cannot legally be excluded under applicable law.
14. Privacy
Cositas de Panamá respects the privacy of its guests.
Personal information collected during the booking process is used solely for purposes related to:
- Managing reservations.
- Operating experiences.
- Providing customer support.
- Communicating important booking information.
- Complying with applicable legal obligations.
Personal information will not be sold to third parties.
Please refer to our separate Privacy Policy for additional information regarding the collection, storage, and processing of personal data.
15. Acceptance of Terms
By booking, purchasing, or participating in any experience offered by Cositas de Panamá, guests acknowledge that they have:
- Read these Terms & Conditions.
- Understood their contents.
- Accepted all provisions contained herein.
- Agreed to comply with the policies established by Cositas de Panamá.
These Terms & Conditions shall be governed by the laws of the Republic of Panama.
